TERMS & CONDITIONS Effective Date: April 2026


1. General Conditions All equipment supplied by Premier Lift Equipment (“we”, “our”, “us”) is sold as‑is, unless otherwise stated in writing. All units are CSA B335‑aligned and MOL‑compliant at the time of delivery based on the configuration purchased.

Specifications are believed to be accurate but are not guaranteed. Photos may be illustrative and may not reflect the exact configuration of the delivered unit.


Availability, pricing, and configuration options are subject to change without notice.


2. Inspection & Acceptance Buyers are responsible for inspecting equipment prior to purchase, delivery, or pickup. Acceptance of a quote, invoice, or delivery constitutes full acceptance of:

  • the equipment condition
  • the configuration purchased
  • the Terms & Conditions outlined on this page


Once accepted, the sale is considered final.


3. Payment Terms Unless otherwise stated in writing:

  • Deposits are non‑refundable
  • Full payment is required prior to release or delivery
  • Overdue balances may incur administrative or storage fees
  • Title transfers only upon full payment


We reserve the right to cancel or refuse orders if payment terms are not met.


4. Warranty & Liability Unless explicitly stated in writing, no warranties—express or implied—are provided, including:

  • merchantability
  • fitness for a particular purpose
  • performance guarantees


We are not liable for:

  • downtime
  • lost productivity
  • consequential or incidental damages
  • misuse, improper operation, or unsafe modifications


The buyer assumes full responsibility for safe operation and ongoing maintenance.


5. Certification & Compliance CSA B335 and MOL compliance apply only to the configuration purchased. Buyers are responsible for:

  • site‑specific compliance
  • operator training
  • workplace safety requirements
  • maintaining certification after delivery


Documentation packages, inspection records, and configuration details are available upon request.


6. Returns & Refunds Due to the nature of material‑handling equipment, all sales are final unless otherwise stated in writing.


7. Limitation of Representations Only written agreements, quotes, and invoices issued by Premier Lift Equipment are binding. Verbal statements, emails, or informal communication do not override written terms.


8. Force Majeure We are not responsible for delays or failure to perform due to events beyond our control, including:

  • supply chain disruptions
  • parts shortages
  • transportation delays
  • labour disputes
  • weather events
  • regulatory changes


9. Indemnification The buyer agrees to indemnify and hold Premier Lift Equipment harmless from any claims, damages, or losses arising from:

  • misuse of equipment
  • improper operation
  • failure to follow safety standards
  • unauthorized modifications


10. Governing Law These Terms & Conditions are governed by the laws of the Province of Ontario. Any disputes will be resolved in Ontario courts.
